General Terms and Conditions of DVKG Deutsche Visa und Konsular Gesellschaft mbH.
§ 1. General
The following General Terms and Conditions constitute the legal basis for the performance of our services. The General Terms and Conditionsare recognized by the customer by placing an order with DVKG Deutsche Visa und Konsular Gesellschaft mbH. For the concluded contract, the following conditions apply exclusively. Deviating or supplementary agreements as well as additional agreements are only valid if they have been confirmed in writing by DVKG Deutsche Visa und Konsular Gesellschaft mbH. Other terms and conditions do not become part of the contract, even if Deutsche Visa und Konsular Gesellschaft mbH do not expressly object to them.
§ 2 Services
DVKG Deutsche Visa und Konsular Gesellschaft mbH offers services for a fee, which enable the acquisition of consular services (visas, A1 certificate, EU-postings, legalizations, etc.) at authorities and consulates. DVKG Deutsche Visa und Konsular Gesellschaft mbH also offers permission-free advice in consular matters, provided that it does not affect the sovereign rights of the Federal Republic of Germany or other nations and / or does not constitute tax advice or legal advice.
DVKG Deutsche Visa und Konsular Gesellschaft mbH is solely committed to providing a service. A contract is only concluded if the order has been expressly accepted. DVKG Deutsche Visa und Konsular Gesellschaft mbH reserves the right to refuse orders without justification.
The service is completed with the order to obtain consular services and hand it over to the customer's designated shipping company. The decision on the issue / issuance of a consular service is incumbent solely with the authority / consulate. If DVKG Deutsche Visa und Konsular Gesellschaft mbH does not have an explicit instruction on the use of a particular shipping company, it is at the discretion of DVKG Deutsche Visa und Konsular Gesellschaft mbH to determine the most sensible way of shipping in the interest of the customer.
DVKG Deutsche Visa und Konsular Gesellschaft mbH is entitled to transfer part or all of it to third parties in order to execute the order.
§ 3 Conditions
The payment for the services, third-party and third-party services, passport fees, shipping fees and consular services fees are based on the current valid price and conditions overview, even if there is no explicit agreement on this. The placing of an order to DVKG Deutsche Visa und Konsular Gesellschaft mbH entitles DVKG Deutsche Visa und Konsular Gesellschaft mbH, subject to a different agreement, to return the documents by cash on delivery and to collect and demand the payment / invoice amount immediately.
It follows from the contract of employment that the obligation to pay for the service provided also exists if a consular service has not been complied.
Claims of DVKG Deutsche Visa und Konsular Gesellschaft mbH may only be set off against counterclaims that are undisputed or legally binding. All conditions and prices are non-binding.
§ 4 Liability
DVKG Deutsche Visa und Konsular Gesellschaft mbH provides all services in the context of the order with the care of a prudent businessman. The decision on granting or denying consualr services lies exclusively with the responsible consulates and authorities. For the rejection of an application brokered by DVKG Deutsche Visa und Konsular Gesellschaft mbH, no liability can and will not be accepted. No liability is assumed for the provision of information.
The services of DVKG Deutsche Visa und Konsular Gesellschaft mbH are aimed at the escort and procurement of consular services, the handing over of the decision of the consulate and / or the authorities about the consular services required and the documents relating to the procurement of consular services. Furthermore, the service is based on the selection of the most sensible processing, transport and shipping method as well as the effect on accelerated processing at the consulate / the authority. Liability for loss, damage and late delivery of the documents sent to the customer can and will not be assumed by DVKG Deutsche Visa und Konsular Gesellschaft mbH. DVKG Deutsche Visa und Konsular Gesellschaft mbH undertakes to assign to the customer any claims it may incur against the shipping company arising from the loss, damage or late transfer of the documents to the customer.
Insofar as the customer incurs damages that were caused by DVKG Deutsche Visa und Konsular Gesellschaft mbH within the scope of the order execution, there is a liability of DVKG Deutsche Visa und Konsular Gesellschaft mbH with a maximum loss amount of EUR 800.00.
The client has to check the delivery immediately after receipt for completeness and conformity with the ordered service and invoice. An obvious defect in the service must be made in writing within seven (7) days of receipt of the documentation or notice of obvious defect. After expiry of the period of notice, such defects can no longer be asserted. Claims against us, irrespective of the legal grounds, become statute-barred in 6 months from the receipt of the documents at your place of business or knowledge of any facts that constitute liability.

The entry requirements, the application documents of the consulates and / or authorities are subject to constant changes. All consular information and documents are updated on an ongoing basis, but DVKG Deutsche Visa und Konsular Gesellschaft mbH excludes any liability for the information and documents provided.
§ 6 Order Cancellation
A cancellation of the order is possible at any time in writing vis-à-vis DVKG Deutsche Visa und Konsular Gesellschaft mbH. Up to the time of cancellation, all costs incurred, pro rata fees and the fees of the return will be charged.
§ 7 Further agreements
Agreements and ancillary agreements that amend and / or supplement these terms and conditions must be in writing in order to be effective. Verbal collateral agreements do not exist.
§ 8 Severability
In the case of the ineffectiveness of individual clauses of these terms and conditions, the validity of the remaining contract conditions remains unaffected.

§ 10 Place of performance and jurisdiction
The contract concluded with DVKG Deutsche Visa und Konsular Gesellschaft mbH is subject to German law, the enforcement of claims under this contract of German jurisdiction. Jurisdiction for both parts is Berlin.
